Dignidad y deberes humanos

Abstract

Resumen: El concepto de dignidad cuenta con una larga historia en la cultura occidental. Contemporáneamente se expandió con la Declaración Universal de los DD HH de 1948, otros tratados internacionales y numerosas constituciones nacionales, mediante las cuales se pretendió consolidar la inviolabilidad de la persona humana. Sin embargo, debido a la indefinición del término empleado y a las disímiles y contradictorias ideologías y corrientes filosóficas, las declaraciones antes mencionadas y el atributo de dignitas otorgado a todo ser humano son pasibles de interpretaciones que siembran profundos desconciertos. Partiendo de la noción que la Filosofía clásica y su continuidad actual brindan a la “dignidad humana”, estas reflexiones apuntan al objeto específico de nuestra preocupación como juristas, o sea al Derecho, cuya noción influenciada por el individualismo también ha sufrido una metamorfosis, que incluye la asimetría con los deberes jurídicos, que han quedado relegados al olvido.

Abstract: The concept of dignity has a long history in western culture. Contemporaneously it has had a grand expansion since the Universal Declaration of Human Rights of 1948, other international treaties, and many national constitutions, through which it was tried to consolidate the inviolability of the human person. However, because of the undefined term used and the dissimilar and contradictory ideologies and philosophical movements, the declarations mentioned above and the attribute of dignitas granted to every human being are passible of interpretations that sow deep disagreements. Starting from the notion that classical philosophy and its current continuity offer to the “human dignity”, these reflections point to the specific object of our concern as jurists, the law, whose notion influenced by individualism has also undergone a metamorphosis, which includes the asymmetry with the legal duties, which have been relegated to oblivion.
