La responsabilidad de sentar un buen precedente : el uso de la fuerza en el derecho internacional

Abstract

Resumen: este artículo analizará el marco normativo del uso de la fuerza y del reconocimiento, por parte de otros Estados, de la soberanía estatal, examinando su regulación a través de tratados, principios generales del derecho internacional, costumbre internacional y la relevancia de los precedentes como fuente de derecho internacional. A partir de este estudio, se desarrollará el daño que provocan al derecho internacional las ficciones generadas por el principio de igualdad soberana y el otorgamiento del monopolio de la fuerza al Consejo de Seguridad de la Organización de Naciones Unidas.

Abstract: this article analyzes the normative framework of the use of force and the recognition, by other States, of State sovereignty, by examining its regulation through international treaties, the general principles of international law, international custom and the relevance of precedents as a source of international law. With this study as starting point, it will develop the damage inflicted on international law by the fictions generated by the sovereign equality principle and the concession of the monopoly of the use of force to the UN’s Security Council.
