La justificación de la eutanasia infantil : aporías desde el interés superior del niño. a propósito de la Sentencia t-544 de 2017

Abstract

Resumen: El propósito del presente trabajo consiste en analizar, desde una perspectiva crítica y en el marco de la decisión que reconoció la llamada eutanasia infantil (Sentencia T-544 de 2017), la manera como la Sala Quinta de Revisión de la Corte Constitucional interpretó y aplicó en esta decisión judicial el interés superior del niño y cuál fue el peso que se le otorgó en la argumentación y en la decisión.

Abstract: The purpose of this paper is to analyze, from a critical perspective and within the framework of the decision that recognized the so-called infantile euthanasia (Decision T-544 of 2017), the manner in which the Fifth Chamber of Review of the Constitutional Court interpreted and it applied in this judicial decision the best interest of the child and what was the weight that was granted to him in the argumentation and in the decision.
