Resumen : Resumen: Un fenómeno actual en nuestro país es el reemplazo de la palabra “conflicto” por “delito” en el dialecto jurídico penal, aludimos a una sustitución metodológica en la normativa vigente y la práctica tribunalicia. Al punto tal que este cambio de paradigma abre camino hacia un Derecho Penal denominado de tres vías. Esto evidencia la relevancia de analizar cómo se recepta esta tendencia en las normas penales; como así también la importancia de determinar cuáles son los presupuestos y fundamentos utilizados por quienes promueven la inculturación de esta nueva terminología. Este trabajo busca precisar estas cuestiones, pues la utilización de la palabra “delito” o el término “conflicto” conduce a consecuencias con diferentes implicancias en el plano social. De ahí la trascendencia de evaluar si este nuevo dialecto jurídico penal se ajusta o no a la medida de razonabilidad del bien común político, llave de bóveda del pensamiento realista clásico.
Abstract: A current phenomenon in our country is the replacement of the word “conflict” with “crime” in the criminal law dialect, we refer to a methodological replacement in current regulations and court practice. This to the point, that this paradigm shift opens the way to a criminal law called three-way. This evidences the relevance of analyzing how this trend is received in criminal legislations; as well as the importance of determining what are the presuppositions used by those who promote the inculturation of this new terminology. This work seeks to clarify these questions, since the use of the word “crime” or the term “conflict” leads to consequences with different implications on the social level. Hence the importance of evaluating whether or not this new criminal legal dialect fits the reasonableness of the common political good, the key to the vault of classical realistic thinking.
