Derecho a la salud : una mirada desde la reciente jurisprudencia de la Corte Suprema de Justicia de la Nación

Abstract

Resumen: La reciente jurisprudencia de la Corte Suprema de Justicia de la Nación en materia de salud continúa ratificando el carácter fundamental del derecho a la salud consagrado constitucionalmente; sin embargo, enfatiza que estos derechos de raigambre constitucional no son absolutos sino que deben ser ejercidos con arreglo a las leyes que reglamentan su ejercicio, siempre que no sean alterados en su sustancia. Tales lineamientos parecieran aportar algunas respuestas a la creciente judicialización de la salud.

Abstract: The recent jurisprudence of the Supreme Court of Justice in the field of health continues to ratify the fundamental nature of the right to health enshrined in the constitution, however emphasizes that these constitutional rights are not absolute but should be exercised in accordance with the laws that regulate their exercise, provided that they are not altered in their substance. Such guidelines seem to provide some answers to the growing judicialization of health.
