Afectación de la cosa juzgada local en las sentencias de la Corte IDH : a propósito del fallo “Fontevecchia”

Abstract

Resumen: El presente trabajo analiza el carácter vinculante de las sentencias de la Corte Interamericana de Derechos Humanos, su integración con el Derecho Interno argentino y la afectación a la cosa juzgada, en función de la eficacia de la protección de los Derechos Humanos en el Derecho Internacional. Ello a propósito del reciente fallo de la Corte IDH, “Ministerio de Relaciones Exteriores y Culto s/ informe sentencia dictada en el caso Fontevecchia y D’Amico vs. Argentina”.

Abstract: This paper analyzes the binding nature of the judgments of the Inter-American Court of Human Rights, their integration with Argentine Domestic Law and the effect of res judicata, depending on the effectiveness of the protection of Human Rights in International Law. The purpose of the recent judgment of the Inter-American Court of Human Rights, “Ministry of Foreign Affairs and Worship Report sentenced in the case of Fontevecchia and D’Amico v. Argentina”.
