Resumen : Resumen: El presente artículo reflexiona sobre el impacto y la posibilidad de innovar en la protección legal vigente del derecho a la vida del niño por nacer en conformidad con los compromisos internacionales asumidos a través de los Tratados de Derechos Humanos. Pretendemos analizar cuál es el margen de apreciación que tiene nuestro país para no incurrir en contradicciones internas ni provocar el reproche internacional, lo que implica armonizar el control de constitucionalidad con el de convencionalidad sin desconocer los Derechos Humanos del embrión en cuanto niño por nacer, a la luz de la aplicación de la Convención sobre los Derechos del Niño, contenida en el artículo 75, inciso 22, de la Constitución Nacional. Su fundamento lo encontramos en la incorporación de la Convención con jerarquía constitucional en las “condiciones de su vigencia”, lo que significa que nuestro país se ha comprometido ante la comunidad internacional a respetar los derechos del niño desde la concepción y hasta los dieciocho años por la declaración interpretativa de la Ley Nº 23.849. De allí deducimos su virtualidad derogatoria de toda norma inferior que la contradiga y la necesidad de contar con las dos terceras partes del Congreso Nacional para una futura modificación.
Abstract: This article reflects on the impact and the possibility of innovating in the current legal protection of the right to live that the unborn child has, in accordance with the international commitments assumed through the Human Rights Treaties. We analyze which is the margin of appreciation that our country has to avoid incurring internal contradictions or provoke international reproach, which implies harmonizing the control of constitutionality with conventionality without ignoring the human rights of the embryo as a child to be born, in the light of the application of the Convention on the Rights of the Child, that is included in article 75, section 22 of the National Constitution. It’s foundation is found in the incorporation of the Convention with a constitutional hierarchy in the “conditions of its validity”. That means that our country has committed itself to the international community to respect the rights of the child from conception until the age of eighteen, according to the interpretative declaration of Law Nº 23.849. From there we deduce the capacity the Convention has to repeal any inferior norm that contradicts it and the need to have two thirds of the National Congress for future modification.
