Maternidad subrogada y dignidad: entre el vacío legal y la conciencia moral a la luz de dignitas infinita

Abstract

El presente artículo se propone analizar, desde la bioética, el concepto de dignidad humana en contextos de vulnerabilidad. Con el fin de lograr un análisis exhaustivo se plantea el siguiente caso clínico: mujer gestante por subrogación que, tras recibir un diagnóstico fetal de trisomía 21, decide continuar con el embarazo pese al pedido de interrupción del mismo y posterior abandono por parte de la pareja comitente. El estudio se fundamenta en los principios del personalismo ontológico, y retoma los aportes de la declaración Dignitas infinita (2024) del Dicasterio para la Doctrina de la Fe, así como de otros documentos del Magisterio como Fratelli tutti. Desde esta perspectiva, se pone de manifiesto la tensión entre autonomía, justicia social, responsabilidad moral y la cultura del descarte, con especial énfasis en la defensa de la vida, la fragilidad humana y el vacío legal. El caso interpela a las prácticas biomédicas contemporáneas y visibiliza cómo si bien en la teoría la dignidad es inherente e inviolable, al ser llevado a la práctica puede verse vulnerada en todos y cada uno de los estratos; social, jurídico, afectivo.

This article aims to analyze, from a bioethical perspective, the concept of human dignity in contexts of vulnerability. To achieve a comprehensive analysis, the following clinical case is presented: a surrogate pregnant woman who, after receiving a prenatal diagnosis of trisomy 21, decides to continue with the pregnancy despite the commissioning couple’s request for termination and their subsequent abandonment. The study is grounded in the principles of ontological personalism and draws on the contributions of the Dignitas Infinita (2024) declaration by the Dicastery for the Doctrine of the Faith, as well as other Magisterial documents such as Fratelli tutti. From this perspective, the article highlights the tension between autonomy, social justice, moral responsibility, and the culture of discard, with special emphasis on the defense of life, human fragility, and legal voids. The case challenges contemporary biomedical practices and reveals how, although dignity is theoretically inherent and inviolable, in practice it may be undermined at every level: social, legal, and emotional.
