El fundamento filosófico de dos visiones del derecho administrativo argentino: El pensamiento de Carlos Balbín y Fernando García Pullés

Abstract

El presente trabajo trata sobre las relaciones que existen entre la ciencia del derecho administrativo y la filosofía. Para esto se hace una contraposición entre las reflexiones de dos administrativistas argentinos: Carlos Balbín y Fernando García Pullés. La elección de estos dos juristas se basa en el hecho de que conciben su objeto de estudio de una manera sustancialmente distinta. De tal modo, el fin propuesto es poner de manifiesto, a partir de las reflexiones jurídico-científicas de los autores argentinos, la vinculación que existe entre ciertas tesis metafísicas, antropológicas y gnoseológicas, y las diversas maneras de conceptualizar el derecho administrativo y, por consiguiente, de abordar sus problemáticas específicas.

This work deals with the relationships that exist between the science of ad ministrative law and philosophy. For this, a contrast is made between the reflections of two Argentine administrative experts: Carlos Balbín and Fernando García Pullés. The choice of these two jurists is based on the fact that they conceive their object of study in a substantially different way. In this way, the proposed goal is to reveal, based on the legal-scientific reflections of the Argentine authors, the link that exists between certain metaphysical, anthropological and epistemological theses, and the various ways of con ceptualizing administrative law and, therefore, consequently, to address their specific problems.
