Derechos humanos: una aproximación conceptual y su relación con la salud

Abstract

Resumen: Este trabajo tiene como objetivo principal desarrollar un análisis conceptual de “Derechos Humanos”. Primeramente se dará cuenta de las definiciones habituales, entre ellas, aquellas facultades e institutos que, en cada momento histórico, concretan las exigencias de libertad, igualdad y dignidad humana, y que deben ser reconocidos por los ordenamientos normativos interno e internacional. A su vez, se pasará revista a sus características (innatos, necesarios, inalienables, imprescriptibles, oponibles erga omnes , universales, laicos, carentes de connotación ideológica, ya sea religiosa o política, fundados en una filosofía humanista e indivisibles. Luego, se enunciarán y analizarán sus fuentes y antecedentes históricos: desde 1945 con la Carta de la ONU, hasta 1993 en la Conferencia de Viena. Además, se estudiarán los principales sistemas de protección tanto a nivel nacional como internacional. Finalmente -y como ejemplo ilustrativo de uno de los Derechos Humanos-, se explicitará a la Bioética, puntualizando el análisis en el derecho a la salud

Abstract: The main purpose of this work is to make a conceptual analysis of “Human Rights”. Firstly, it will provide the customary definitions, including, inter alia, those powers and rules which have, on each period of history, set forth the demands for freedom, equality and human dignity which ought to be recognized by the domestic and international legal systems. In addition, it shall review the features thereof (i.e., innate, necessary, inalienable, imprescribable, enforceable erga omnes, universal, lay, lacking any ideological connotation, be it religious or political, based on a humanistic philosophy and indivisible). Then it shall enumerate and analyze the sources and historical backgrounds thereof: from 1945, with the issuance of the UN Charter, to 1993 at the Vienna Conference. In addition, the main protection systems, both at a domestic and international level, shall be studied. Finally -and by way of example of one of the Human Rights- Bioethics shall be explained with a special emphasis on the analysis of the right to health
