Las técnicas de procreación artificial heterólogas : análisis bioético y jurídico

Abstract

Las técnicas de procreación artificial, entendidas como el conjunto de procedimientos técnicos ordenados a la concepción de un ser humano por una vía diversa de la unión sexual entre varón y mujer, suscitan variadas problemáticas ético-jurídicas. El presente trabajo analizará un aspecto especialmente grave de estas técnicas: la utilización de gametos de terceras personas extrañas al matrimonio; técnica que usualmente se denomina fecundación “heteróloga”. En este marco se considerarán las modalidades de esta técnica, los principios ético-jurídicos implicados, las objeciones que merece y la respuesta que se plantea desde el Derecho argentino.

The techniques of artificial procreation -technical procedures which obtain human conception through a means other than the sexual union between male and female- arouse several ethic-legal issues. The present work analyzes an especially serious aspect of these techniques: the use of gametes from third parties outside the married couple, usually called “heterologous” fertilization. Within this framework, the article deals with the methods of this technique, the ethic-legal principles involved, all due objections, and the response given by argentine law.
