Eutanasia en la bioética judía: considerandos, resoluciones y aportes

Abstract

Resumen: Los trabajos más recientes y de mayor resonancia sobre el suicidio y la eutanasia han focalizado en sus aspectos psicológicos, sociológicos y jurídico-filosóficos sobre el derecho o no del individuo a disponer sobre la voluntaria finalización prematura de su vida. No obstante, estas importantes perspectivas tienden a reducir aquel acto a planteos dicotómicos y polarizados basados en lo patológico o una cierta anomalía acorde a cada tesitura, sin una relación interdisciplinaria ni propuesta superadora de las problemáticas propias de cada una de aquellas disciplinas. Es por ello que en este trabajo se aborda el problema del suicidio y la eutanasia no como uno funcional psicosomático, sino como uno existencial del hombre e incluyente de aquél, presentando sus antecedentes y definiciones fundacionales, distinguiendo lo ético de lo patológico, analizando los significados o sentidos axiológicos que la persona le otorga a su vida, a su existencia, y sus fundamentos e implicancias respecto del suicidio y eutanasia. Todo ello articulado en un análisis filosófico con la estructura conceptual, casuística y fundamento del marco jurídico regulatorio y normativo judío respecto de la prohibición, deber o permisión de quitarse la vida por sí mismo o mediante terceros. Luego y a la luz de este análisis y sus consecuentes resoluciones respecto de la cosmovisión judía como sistema cultural-legal monoteísta, se aporta una alternativa superadora a aquellos planteos dicotómicos. Y cuya relevancia radica en que dicha contribución no demanda la necesidad de adscribir al judaísmo para su anuencia, sino que por las propias categorías y metodologías utilizadas, sus conclusiones pueden ser aplicadas también al campo de la moral y el derecho en las acuciantes discusiones bioéticas actuales.

Abstract: The most recent and most resonant works on suicide and euthanasia have focused on the psychological, sociological and legal-philosophical aspects of the individual’s right or not to decide on the voluntary premature end of his or her life. However, these important perspectives tend to reduce that act to dichotomous and polarized approaches based on the pathological or a certain anomaly according to each situation, without an interdisciplinary relationship or a proposal to overcome the problems of each of those disciplines. That is why in this paper the problem of suicide and euthanasia is approached not as a functional psychosomatic one, but as an existential one of man and inclusive of the former, presenting its background and foundational definitions, distinguishing the ethical from the pathological, analyzing the axiological meanings or senses that the person gives to his life, to his existence, and its foundations and implications with respect to suicide and euthanasia. All this articulated in a philosophical analysis with the conceptual structure, casuistry and foundation of the Jewish regulatory and normative legal framework regarding the prohibition, duty or permission to take one’s own life or that of third parties. Then, and in the light of this analysis and its consequent resolutions regarding the Jewish worldview as a monotheistic cultural-legal system, an alternative to those dichotomous approaches is provided. Its relevance lies in the fact that this contribution does not demand the need to ascribe to Judaism for its acceptance, but rather, due to the very categories and methodologies used, its conclusions can also be applied to the field of morality and law in today’s pressing bioethical discussions.
