Acerca de la situación institucional de la Ciudad Autónoma de Buenos Aires

Abstract

Resumen: La Ciudad ha sido cabeza del gobierno virreinal y luego de la Provincia originaria de Buenos Aires, realidades históricas irrebatibles; como también lo es que en 1880 fue federalizada como Capital de la Nación y designada sede de sus autoridades federales. Asimismo, cabe recordar que, en ocación de la promulgación de una ley de mudanza del Gobierno en 1987, se proyectó convertirla en una provincia independiente y que su actual autonomía se encontraba ya predispuesta al citarse la Convención Reformadora de la Constitución por la Ley N° 24.309. En dicha reforma de 1994, se la constituyó Ciudad Autónoma descentralizada por el actual artículo 129 de la Constitucion Nacional, ubicado dentro del Capítulo de Gobiernos de Provincia, con un régimen análogo, pero no exactamente igual, al de las provincias, aunque- cabe decir- está a la par de ellas representada en el Senado. Su limitación surge de que todavía es sede del Gobierno Federal, por lo que la progresiva asunción de sus competencias ha quedado sujeta a las leyes del Congrso Nacional, dicatadas a fin de la conciliaci´n de estos cambios con los intereses de la residencia de las autoridades federales.

Abstract: The City has been head of the viceregal government and then of the original Province of Buenos Aires, irrefutable historical realities; as is also the case that in 1880 it was federalized as the Capital of the Nation and designated the headquarters of its federal authorities. Likewise, it should be remembered that, on the occasion of the promulgation of a government moving law in 1987, it was planned to make it an independent province and that its current autonomy was already predisposed when the Constitutional Reform Convention was cited by Law No. 24,309. In said reform of 1994, it was constituted as a decentralized Autonomous City by the current article 129 of the National Constitution, located within the Chapter of Provincial Governments, with a regime analogous, but not exactly the same, as that of the provinces, although- it should be said - is on a par with them represented in the Senate. Its limitation arises from the fact that it is still the seat of the Federal Government, so the progressive assumption of its powers has been subject to the laws of the National Congress, enacted in order to reconcile these changes with the interests of the residence of the federal authorities.
