Convención de Naciones Unidas sobre la compraventa internacional de mercaderías : cuestiones conexas al incumplimiento y su estudio sobre la aplicabilidad a los contratos de distribución

Abstract

Resumen: El presente Trabajo Final Integrador estudia pormenorizadamente cuestiones controversiales con respecto a la CISG, repasando previamente la historia y antecedentes de la Convención, centrándose, en primer término, en si actualmente la Convención se aplica; también estudia las disposiciones generales y principios de la Convención, los diferentes conceptos centrales utilizados en ella que no cuentan con definición legal alguna, así como también se realiza un análisis exhaustivo del incumplimiento y causales de exoneración de responsabilidad en la CISG; finalmente, analiza la posibilidad de aplicar la Convención a los contratos internacionales marco de distribución.

Abstract: This thesis study in detail and analyzes controversial issues related to the CISG, studying first the legal frame and background of the Convention, and then focus on the avoidance or exclusion of the CISG; also analyzes the principles of the CISG and their main dispositions, key concepts without a definition that the CISG use, and furthermore studies the breach of contracts and exemptions under the CISG scope; finally, analyzes international distribution contracts within the scope of the CISG.
