Resumen :	Resumen: En esta investigación sobre la doctrina de la arbitrariedad de sentencia por defecto de fundamentación, aplicada a un fallo sobre maternidad subrogada, se demuestra que la sentencia analizada es infundada por incurrir en exceso hermenéutico, funcional y dogmático. Abstract: In this investigation into the doctrine of the arbitrariness of judicial sentences due to the lack of grounds applied to a verdict on surrogate motherhood; it is shown that the sentence analyzed is unfounded due to hermeneutic, functional and dogmatic exceedance.
