Aspectos bioéticos y juridicos del manejo del cadaver : “Un análisis del estatus mortem y su consonancia ética en la praxis”

Abstract

Resumen: El cadáver humano trae consigo una serie de incertezas que van desde cuestiones estrictamente nominales, como su definición real; normativas, como la atribución de derechos; o éticas, como las valoración moral sobre su manipulación. La visión neomoderna de la muerte condicionó al cadáver a un estado de completa objetivación, arrojándolo al más radical de los utilitarismos. Prueba de ello son las múltiples situaciones de ética reprochable en cuanto al manejo del cuerpo muerto, particularmente, en la esfera biosanitaria. A partir del análisis bioético-jurídico y la integración de sus dimensiones conexas, el artículo aporta elementos para la búsqueda de una definición holística, su estatus mortem. Definición que ofrece luces en la identificación de actos vejatorios e irrespetuosos de la dignidad especial de los muertos.

Abstract: The human corpse brings with it a series of uncertainties that range from strictly nominal issues, such as its real definition, to regulations, as the attribution of rights, or to ethics, as moral evaluations of their manipulation. The neomodern view of death conditioned the corpse to a state of complete objectivation, throwing it into the most radical of utilitarianisms. Proof of this is the multiple situations of reprehensible ethics regarding the management of the dead body, particularly in the biosanitary sphere. From the bioethical-legal analysis and the integration of its related dimensions, the article provides elements for the search in a more holistic definition, its estatus mortem. Definition that offers lights in the identification of degrading and disrespectful acts of the special dignity of the dead.
