La costumbre en el Derecho Canónico Indiano

Abstract

Resumen: El artículo estudia la vigencia de la costumbre en el mundo canónico indiano. Luego de presentar su evolución y desarrollo en el derecho universal analiza la doctrina sobre la materia a partir de autores indianos. Se expone la vigencia del derecho consuetudinario en diversos ámbitos de la vida eclesiástica americana concluyendo en afirmar el amplio imperio de este derecho en la Iglesia de Indias y, señalando que entorno al siglo XVIII se comienza a percibir cierta desconfianza hacia esta fuente del derecho canónico con normas que tienden a otorgar mayor contralor al legislador.

Abstract: The text studies the costum’s applicability in the canonic indian world. After presenting its evolution and development in the universal law, it analyzes the doctrine upon the subject through indian authors. The article exposes the applicability of the common law in different areas of the american eclesiastic life, cloncluding with the afirmation of the rule of this law in the Indian Church, and pointing the fact that in the surroundings of the XVIIIth century a certain mistrust towards this source of canonic law is perceived, with regulations that tends to bestow a major control to the legislator.
