El título preliminar del Código Civil y Comercial como núcleo de significaciones

Abstract

Resumen: El autor analiza en el Título Preliminar del reciente Código Civil y Comercial argentino el capítulo denominado “del ejercicio de los derechos” donde se dan las mayores novedades comparándolo con el Código Civil de Vélez Sarsfield, tales como la pluralidad de fuentes y la aparición de dos principios, el abuso del derecho y el de buena fe. También entiende que si consideramos que tal Título Preliminar comporta un verdadero núcleo de significaciones, nos encontramos con el problema de su interpretación, que –conforme a la tendencia del neoconstitucionalismo adoptada– no admite univocidad.

Abstract: The author analyzes in the Preliminary Title of the recent Argentine Civil and Commercial Code chapter called “exercise of Rights” where there are the biggest news in comparison with the Civil Code of Velez Sarsfield, such as the plurality of sources and the appearance of two principles, abuse of law and good faith. Also it believes that if we consider that such Preliminary Title implies a real core of meaning, we find the problem of interpretation, which –according to the tendency of adopted-neoconstitutionalism not support a unique interpretation.
