Apostillas iusfilosóficas sobre el derecho a la jurisdicción

Abstract

Resumen: El artículo aborda el “derecho a la jurisdicción” desde una perspectiva iusfilosófica. Para tal fin define su concepto, describe las diferentes perspectivas teóricas tales como la positiva o necesaria del realismo, la negativa y contingente del marxismo y la irrelevante del liberalismo. Luego aborda sus fundamentos, alcances y obstáculos para su ejercicio apropiado. El abordaje de estas cuestiones permite advertir que el derecho a la jurisdicción no es sólo una problemática del derecho procesal sino que constituye una pieza clave del Estado de Derecho Constitucional.

Abstract: The article approaches the “Right to Jurisdiction” from a philosophy of law’s perspective. To that purpose it defines its concept; it describes the different theoretical perspectives such as “the positive” or “the necessary” from realism, the “negative and contingent” from Marxism and “irrelevant” from the liberalism. Then it approaches its bases, scope and obstacles to its appropriate exercise. The treatment of these questions allows reminding that the “Right to Jurisdiction” is not only of Procedural Law but rather it plays a key role in the Constitutional State Law.
