Legalidad, legitimidad y exepción en Jenofonte:el caso de la monarquía

Abstract

Este trabajo analizará el problema de la legalidad y la legi- timidad en la filosofía política de Jenofonte centrándose en pasajes clave de Ciropedia y Memorabilia. Para comprender el retrato de am- bos conceptos se recurrirá a la figura de la monarquía, trabajada por el autor socrático. El trabajo propondrá que el tratamiento de la legitimi- dad y legalidad supone una categoría no abordada explícitamente por el autor: la excepción. Así, el pensamiento de Jenofonte se puede ver como un antecedente para categorías de análisis contemporáneas que brindan un enfoque dúctil al estudio de los sistemas político-jurídicos.

This paper presents the topics of legality and legitimacy in Xenophon's Political Philosophy, focusing on key passages from Cyropaedia and Memorabilia. To understand the portrait of both con- cepts the paper addresses the portrait of monarchy extensively de- scribed by the Socratic author. The paper proposes that the treatment of legitimacy and legality involves the exception: a category not ex- plicitly mentioned by the author. Thus, Xenophon's thought can be understood as a precedent for contemporary categories of analysis that allow a flexible approach to the study of political-legal systems.
