La consulta popular en la Argentina. ¿Es constitucional convocarla para dolarizar?

Abstract

Este artículo aborda los mecanismos de democracia directa adoptados en la última reforma de la Constitución argentina. En primer lugar, se clasifican las distintas modalidades y se señalan algunos debates sobre las venta-jas asociadas con tales mecanismos. Luego, se analiza la naturaleza, alcance e implementación de la iniciativa y la consulta popular a partir del nuevo texto constitucional. Finalmente, se evalúa la constitucionalidad del recurso a una consulta popular sobre cuestiones monetarias, argumentando que es admisible convocarla según lo dispuesto en el artículo 40 y la ley reglamentaria. Adicionalmente, la consulta se alinearía con los principios constitucionales de soberanía popular, protección del derecho de propiedad y la promoción del bienestar y la prosperidad general.

This article addresses the direct democracy mechanisms adopted in the latest reform of the Argentine Constitu-tion. The first section classifies the different modalities and highlights some debates on the advantages associa-ted with such mechanisms. The second section analyzes the nature, scope, and implementation of the initiative and popular consultation based on the new constitutional text. The third section evaluates the constitutionality of resorting to a direct popular vote on monetary matters and argues that it is admissible to convene one accor-ding to the provisions of Article 40 and the regulatory law. Additionally, the consultation would be aligned with the constitutional principles of popular sovereignty, protection of property rights, and the promotion of general well-being and prosperity
