Los pactos interprovinciales y las características del constitucionalismo provincial

Abstract

Resumen: En este trabajo se analizan las características del constitucionalismo provincial y la relación entre las provincias, desde el año 1820 hasta la sanción de la Constitución Nacional en el año 1853. Concretamente se abordan los siguientes puntos: el constitucionalismo provincial en la primera mitad del siglo XIX; las bases del sistema federal, los acuerdos interprovinciales y, en particular, el Pacto Federal de 1831, junto a las consideraciones actuales de la doctrina y de la jurisprudencia respecto a los pactos preexistentes.

Abstract: This paper analyzes the characteristics of provincial constitutionalism and the relationship between the provinces, from 1820 until the enactment of the National Constitution in 1853. Specifically, the following points are addressed: provincial constitutionalism in the first half of the nineteenth century; the bases of the federal system, the interprovincial agreements and, in particular, the Federal Pact of 1831, together with the current considerations of doctrine and jurisprudence regarding the pre-existing pacts.
