Humanos –en adelante, Corte IDH– utilizó el concepto de “vida digna
o existencia digna” para dotar de contenido y protección al derecho
a la salud. El problema que plantea la expresión “vida digna”
es que es usada en el discurso jurídico de la Corte IDH con distintos
alcances semánticos sin que exista unanimidad en su significación. A partir de ello, este artículo analiza los diferentes usos del concepto
“vida digna” en los casos contenciosos tramitados ante la Corte
IDH en los que se constataron violaciones al derecho a la salud, y
finalmente ofrece algunas reflexiones sobre las implicancias de estos
usos en materia sanitaria. Abstract: For a long time, the Inter-American Court of Human Rights employed the concept of “dignified life or dignified existence” to provide content and protection to the right to health. The problem that entails the expression “dignified life” is that it is employed by the Court’s legal discourse with varying semantic scopes, never reaching unanimity when it comes to its meaning. From there, this article analyzes the different uses of the concept of “dignified life” in the contentious cases the Court ruled over, where violations to the right to health were verified, and finally offers some reflections on the consequences of these uses in sanitary matters. |
