Régimen de coparticipación municipal : ¿deber o conveniencia?

Abstract

Resumen: La reforma constitucional de 1994 vino a cristalizar una necesidad que había sido anticipada por la Corte Suprema: la autonomía municipal. No obstante, el nuevo estatus que adquirió el municipio en el ordenamiento jurídico trajo aparejados otros inconvenientes que no habían sido dimensionados por la Convención Constituyente. El presente comentario propone la obligación de incluir en la futura “Ley Convenio de Coparticipación”, prevista en el art. 75, inc. 2º, de la CN, un régimen de Coparticipación Municipal que establezca los presupuestos mínimos que garanticen a los municipios el ejercicio de atribuciones en el orden institucional, político, administrativo, económico y financiero como una forma de realización del federalismo.

Abstract: The 1994 Constitutional Amendment crystallized a need that had been anticipated by the Supreme Court: the municipal autonomy. Despite this, the new status that municipality has acquired on the legal system brought other issues that were not considered by the constituent assembly. The present commentary proposes including in the future “Agreement Act of Coparticipation”, foreseen at article 75, section 2, of the National Constitution a municipal coparticipation regime that would establish minimum requirements to guarantee the municipalities the exercise of their attributions in the institutional, political, administrative, economical and financial order, as a way of improving the federalism form.
