Apuntes sobre el principio dispositivo y de congruencia como límites a la declaración de inconstitucionalidad de oficio

Abstract

Resumen: La posibilidad de que los jueces declaren la inconstitucionalidad de una norma, sin que medie petición de parte, ha generado sin duda alguna un ferviente, no obstante enriquecedor, debate en el derecho constitucional argentino. El presente trabajo procura efectuar un análisis crítico sobre el control de constitucionalidad de oficio, a contrario sensu de la postura mayoritaria que lo respalda. Intentaré explicar por qué dicho mecanismo debiera ser restringido, en relación con el lugar que hoy le otorgan los tribunales y buena parte de la doctrina.

Abstract: The possibility that judges declare the unconstitutionality of a norm without the request of a party has undoubtedly generated a fervent, though enriching, debate among the argentine Constitutional Law field. The present paper seeks a critical review on the ‘ex officio’ constitutionality control, opposing the majority position that supports it. While I believe that it has a reserved place in our constitutional system, that place should be even more restricted than the one granted by the courts today and much of the doctrine.
