Resumen : Resumen: Este trabajo de revisión tiene como
objetivo entender cómo se interpreta
el concepto de discapacidad en las
patologías diagnósticas en la vida
prenatal que puedan asociarse con
discapacidad en la vida postnatal.
Para ello se va a analizar el marco
jurídico que reconoce los derechos
de las personas por nacer en quienes
se diagnostica una enfermedad que
puede asociarse con discapacidad en
la vida postnatal.
La posibilidad de que la persona por
nacer tenga un diagnóstico acerca
de su estado de salud está contemplada
en nuestra legislación, siendo
asumido por el sistema público, el
sistema de obra sociales y el sistema
privado de salud. Nuestra legislación
no contempla explícitamente
la terminación de una gestación,
excepto en los casos en que la
patología diagnosticada se interprete
como incompatible con la
vida, y sólo a partir de la viabilidad.
Entonces la implementación del
diagnóstico prenatal puede generar,
un dilema controversial. Es posible
interpretar al diagnóstico prenatal
como una herramienta que permite favorecer el mejor desarrollo y
adaptación del niño por nacer y sus
familias. O bien, asumir que el
diagnóstico prenatal es una herramienta
que facilitará evitar el nacimiento
de niños con estas patologías,
terminado tempranamente la
gestación. El objetivo del trabajo es
realizar una reflexión bioética acerca
del reconocimiento que hace
nuestro sistema legislativo respecto
de las enfermedades que pueden
diagnosticarse prenatalmente.; Abstract: The objective of this review is to
understand how the concept of
disability in the diagnostic
pathologies in prenatal life, which
can be associated with disability in
postnatal life, is interpreted. In
order to do that, the legal
framework in which the rights of
the unborn persons who are
diagnosed with an illness that can
be associated with a disability in
postnatal life will be analyzed.
The possibility for the unborn
person to have a diagnosis of
his/her health is provided for by our
law, and assumed by the public
system, the regular health
insurances and the private health
system. Our law does not explicitly
provide for the termination of fetal
gestation, except for those cases in
which the diagnosed pathology is
understood as incompatible with
life, and only based on the fetal
feasibility. So, the implementation
of the prenatal diagnoses can result
in a controversial dilemma.
It is possible to understand a
prenatal diagnosis as a tool that
can help to facilitate a better development and adjustment of the
babies to be born and their
families. Also, it can be assumed
that the prenatal diagnosis is a tool
to prevent babies with such
pathologies from being born by
means of the premature
termination of the gestation. The
objective of this work is to make a
bio-ethical reflection about the
recognition on the part of our legal
system of those illnesses that can

Resumen : Resumen: Distintos preceptos bíblicos, según
las interpretaciones de algunos
ambientalistas, dan a la especie
humana una tan irrestricta como
absoluta potestad sobre la naturaleza,
y por ello la cultura bíblica es
considerada por aquellos la causa
de la corrupción actual del medio
ambiente. En este trabajo, el Rab.
Dr. Fishel Szlajen, no sólo analiza
dicho fenómeno cmo una interpretación
descontextualizada y tendenciosa
del propio marco cultural
y lingüístico al cual pertenecen
dichos preceptos, sino también
investiga y expone, mediante referencias
a las fuentes más importantes
como prístinas del judaísmo,
más sus relevantes filósofos y/o
exégetas, el acervo prescriptivo y
proscriptivo dentro del cual algunos
de los tópicos más importantes de
dicha cultura en relación al hombre
y su medio ambiente muestran el
camino hacia la rectificación conductiva.
Este marco propuesto por
el judaísmo resulta en un vigente
mensaje de equilibrio y mesura para
toda la sociedad, por un lado, en
pos de lidiar con la actual y grave situación ambiental; y por el otro,
para el renovado neo-paganismo
manifiesto en ciertos movimientos
ambientalistas radicales, quienes
trasladan, polarizando, el problema
de la moderna egolatría al postmoderno
Deus sive natura.; Abstract: According to the interpretation of
some environmentalists, different
Biblical precepts give the human
kind an unrestricted and absolute
authority over nature, that is why
the Biblical culture is considered to
be the cause of the present
corruption of the environment. In
this work, Rabbi Dr. Fishel Szlajen,
not only analyzes such
phenomenon as a decontextualised
and biased interpretation of the
cultural and linguistic framework to
which such precepts belong to but,
by means of references to the most
important and pristine sources of
Judaism, and its relevant
philosophers and/or exegetes he
also researches and presents the
prescriptive and proscriptive
tradition within which some of the
most important topics in relation to
human beings and their
environment show the way toward
the conductive rectification. On the
one hand, this framework proposed
by Judaism results in a current
message of balance and moderation
for the society as a whole; on the
one hand to deal with the present environmental serious situation;
and on the other, with the renewed
new-paganism seen in some radical
environmental movements, which
by polarizing, move the problem of
the modern egocentricity to the

Resumen : Resumen: Al concebir una «Ética global»,
hemos de poner esta ética aplicada
en relación con el fenómeno de la
globalización, que se impone a la
humanidad asumiendo «la tecnología
y su desarrollo junto con un
paradigma homogéneo y unidimensional
» (LS, 106). Frente a ello,
hemos de preguntarnos si estamos
ante una «Globalización de la Ética»
o ante una «Ética de la
Globalización». La primera propuesta
entiende que el fenómeno de la
globalización contiene en sí mismo
una ética; la segunda, en cambio,
sostiene que la globalización no
tiene de suyo entidad moral, sino
que cae bajo el examen de la ética
general, política y jurídica. A su vez,
la preocupación ecológica, inserta
en esa cultura de la globalización,
se sustenta en teorías tecnocráticas,
con una visión naturista e
infrahumana de la sociedad y de la
realidad en su conjunto, ajenas a la
dignidad de los individuos y de los
pueblos (LS, 91). Una «Ética global»
ha de salvaguardar una ecología
integral de los sistemas naturales y
sociales (LS, 137…). Ecología del ambiente, de la economía y de la
política (LS, 53); ecología de la historia,
de la cultura (LS, 143) y de las
generaciones futuras (LS, 159), lo
cual solo es factible en el marco de
la justicia (LS, 153) y del bien
común (LS, 157).; Abstract: When conceiving a “global Ethics”,
we have to relate such applied
ethics to the phenomenon of
globalization, which is imposed to
the human kind assuming “the
technology and its development
together with an homogeneous and
one-dimensional paradigm” (LS,
106). In the face of this, we should
ask ourselves if we are before a
“Globalization of the Ethics”. The
first proposal states that the
phenomenon of globalization
contains an ethics in itself; in turn,
the second proposal argues that
globalization does not have an
ethics in its own right, but instead
it falls under the examination of
the general, political and legal
ethics. Likewise, the ecological
concern inserted in that culture of
globalization is based on
technocratic theories with a
naturist and subhuman view of the
society and the reality as a whole,
alien to the dignity of the
individuals and the peoples (LS, 91).
A “Global ethics” has to safeguard
an integral ecology of natural and
social systems (LS, 137...). Ecology of the environment, of the
economy and of the politics (LS,
53); ecology of the history, of the
culture (LS, 143) and of the future
generations (LS, 159) which is only
feasible in the framework of law
(LS, 153) and the common welfare.
