Serão traçadas reflexões acerca dos comportamentos aristocráticos em relação à família e ao luto, e, dessa forma, ao analisar a prática da uirtus, compreender-se-ão a criação de normas de condutas para a expressão pública da dor e a inserção de dimensões mais particulares e emocionais no modo como se lembravam dos mortos sob a perspectiva de Sêneca.; This article aims to understand representations of death and its relations with the memory from mortuary setting and its family relationships in the philosophical logos of Lucius Annaeus Seneca by examining the impact representations of death in the Neron court at the time of AD 62. To do that, we must keep in mind that the first emperor of the Severan dynasty is usually characterized historiographically as a soldier-emperor or even as a barbarian-emperor. Examples are the cases of Agrippina “the Younger”, in the Roman period, and of Congresswoman Flordelis, in the present day in Brazil. The methodological path followed includes bibliographical research, jurisprudence analysis and comparative method. Norms are identified in the Institutes of Gaius, in Justiniano's Digest, in the Ordinances of the Kingdom of Portugal, in Canon Law, in the Brazilian Civil Codes, in the Brazilian Penal Code, and in the Brazilian Federal Constitution. The comparative analysis of the results shows similarities and differences in such norms. A discussion of the validity of the grounds for such impediments checks for possible reasons for violations or relaxations.; Esta pesquisa tem como objetivo identificar impedimentos ao casamento existentes no Direito Romano e no ordenamento jurídico brasileiro atual, e flexibilizados em certos casos célebres. Exemplos são os casos de Agripina “a Jovem”, no período romano, e da deputada Flordelis, na atualidade brasileira. O percurso metodológico seguido inclui pesquisa bibliográfica, análise de jurisprudência e método comparativo. São identificadas normas nas Institutas de Gaius, no Digesto de Justiniano, nas Ordenações do Reino de Portugal, no direito canônico, nos Códigos Civis brasileiros, no Código Penal brasileiro, e na Constituição Federal brasileira. A análise comparativa dos resultados entre os ordenamentos dessas épocas mostra semelhanças e diferenças em tais normas.
